Maybe it is, or maybe it isn't. But there are other public statements by Neelie the Terrible, such as her belief that anyone with the amount of market share that Intel has must be an illegal monopoly.

Bottom line is that there is much evidence that the EU is purposely throwing its authoritarian weight around, thinking that they themselves are the law. I don't know if Intel has much of a chance on appeal, given the nature of EU politics, but I do think Intel has a good basis for a PR campaign.
