I doubt there is anyone left on the planet who doesn't think Intel will be found guilty and fined tomorrow. Probably 1 Billion Euros. It is certainly factored into the share price and it will be years before it makes it way through the courts, no? As such it seems like a formality to me.

There is a higher court than First Instance to appeal points of law. Which is European Court of Justice. Microsoft decided to not appeal on that basis. But my guess is that Intel will appeal based on law, because the dispute is specifically on which law governs rebates and prices. Especially if a fine is imposed based on law that was not already defined.
