This argument of the company contracting or buying directly from Tectane is invalid. You can compare it to any company that owns the rights to another company's products.

I would use the following example from one of my businesses, which is forestry consulting, to illustrate this point. Private landowners sign exclusive contracts with me to sell their timber. If someone wants the timber from the landowner they cannot go to the landowner and buy the timber, the landowner does not "own" all rights to it anymore. The only legal means of acquiring the timber would be to wait until the contract is done (99 years for PGYC/Tectane), buy the contract, or buy my company for the timber rights. Does anyone see it differently?
