madoff: lied to investors for the purpose of intentionally deceiving them so he could steal from them.

ak: in an effort to successfully establish a revolutionary music business model, negotiated in a near-impossible environment to achieve what no other person/company has achieved to-date. in the process he communicated mis-information -- not intentionally, but because the process, including negotiating agreements with hyper-defensive labels' execs and their armies of attorneys, was totally unpredictable.
