Are you kidding? Almost all stocks have some movement before news is released. Not much you can do about it. The SEC is supposed to keep this in check, but we all see how great a job they have been doing lately huh? Letting a $50B ponzi scheme go on after they have been repeatedly alerted for years about the fraud. That is the real sham(e)

Slicken,

Ever heard the saying, "buy the rumor, sell the news"? King has indicated that trial updates will happen in late 2008 or early 2009. Anticipation is building. IMO, that MM's and astute traders are starting to buy in anticipation of the "news" or release of data. They are expecting that the news will be good and that the publicity will attract buyers, new and old. If it goes as planned, the buyers will show up and the guys that are buying now will be there to sell them their shares. If the news is good and they don't have enough shares to stop the rise, we're off to the races. If the news is just ok, the selling from these "front runners" will slow the rise, eventually stop it, and void new news, we'll head down again. Neat thing here is that we're expecting many news events. So, the old buy the rumor and sell or short into the news is getting riskier.

Slicklen, why do you feel management would be at fault if there was a leak?

There are so many people involved in ongoing trials and studies. Doctors, researchers, even patients potentially have inside information they could leak. I spent a couple of years working for a mergers/acquisitions team for a large electronics manufacturer. We all had to sign non-disclosures. Yet amazingly enough every acquisition we made had their stock run before the announcement was made. You can't completely stop leaks from happening. The best you can do is cover your own butt.
