Any repurchases of shares by the company are fully disclosed in either the 10Q or 10K filings. In addition, if a member of management (or other "insider") purchased shares, that would have to be disclosed as well via a Form 4 filing.

IMHO they are waiting to spend the 2M in buy back money.

If GNPH wants to uplist to NasDaq, then they need a $5 minimum for PPS. They may be waiting to see what happens with the lawsuit. I think some people got out when they did the R/S. If the lawsuit is unfavorable for GNPH, they can just buy cheap shares and support the PPS. If the lawsuit goes well, GNPH could try to raise the PPS to at least $5 and maintain it there before an uplisting.

2009 will be interesting for GNPH because of the on going lawsuit, pending drug approvals (which adds EPS to the equation) and uplisting (but where?). The next Q profits will also give an indication to how strong GNPH is at making a profit in a down economy. China's economy might not be as bad a the USA, but everything is connected.
