Well,

I really think Nellie Croes and her gang of henchmen will throw the bag at INTC. Probably a hefty fine - probably in the billions is inevitable. The prevailing winds are too strong - The arguments are weak... Gotta hand it to AMD they really did the smear campaign with gusto and they have succeeded.

At this point in time - I have to say is - it won't matter.

Once all of these anti-trust matters are put to rest sometime after 2010 - AMD will be reduced to mere crumbs anyway.

What is really sad about this whole PR campaign is that IF AMD had put as much energy and money into crafting a succesful business plan - they would probably be eating INTC 's lunch..

Yes public opinion has been swayed - that's teh other part of thsiproblem. AMD has damaged INTC's reputation.. Heck look at Microsoft - INTC is looked at in the same light...
When KFTC comes out of the blue and slaps a fine on INTC -
I can only think that AMD has pressured them to do so... Not because it is correct - but because AMD has momentum in this arena...The EU issue is swaying global thought on this INTC issue..

but it is too late and AMD is done...

AMD has fallen on the sword and they can't get up...this is true...

I think that's the only relavent proximity. Some economists are unhappy with US courts precedents that say as long as price is above avg variable cost, then it is legal regardless of how much it harms competitors. I am guessing the new person at the FTC is one of those unhappy folk.

Unfortunately for him and for AMD, the courts don't give a darn about his unhappiness. the per-se legal standard is still avg variable cost.

That's why AMD now is in a deposition panic, because they have to show some other Intel actions that are illegal in themselves. Since volume rebates are not illegal. Even if they force AMD to lower prices, suffer losses, and eventually go out of business.
