NeoMedia's corporate charter lists both poison pill and well as anti-take over measures, which leads me to believe that if there is a take over attempt, it won't be hostile due to above. It will nonetheless be interesing to see how strong the patents hold under PTO re-exam. Hopefully no appeal process will be warranted and we can then turn our attention back over to the SB patent infringement suit in NY Federal Circuit Court under the auspices of Judge John E. Sprizzo, Lower Manhattan District. Additionally, it's also my understanding that even if some of the EFF's claims are upheld by the PTO, NeoMedia still has the right of appeal and these appeals 'generally' fall in favor of the original patent holder by percent analysis. Unfortunately the appeals process would tie us up on the ropes again for an indefinite amount of time. Here's to a clean review.
