My question:
Regarding the Fujitsu Ten announcement yesterday...
1. Will this be ‘binding' arbitration? That is, what will force Fujitsu Ten to pay e.Digital should they be judged to be in breach of the contract?
2. It's implied that this might be a relatively quick process/decision since the possibility of still providing preliminary numbers (which could possibly include the settlement) for the last quarter was mentioned. I assume such would have to happen before June 30 to remain ‘preliminary'. Is the company reasonably anticipating a quick resolution?
His response:
Thank you for your e-mail. It is binding arbitration under the Supply Agreement. A settlement or an arbitration award would need to occur before late June to be considered for inclusion in the quarter and fiscal year ended March 31.

Obviously no guarantees, but I think they hope to have this wrapped up by the end of June.
