I think you are on to something. I called Ed Walker, the partner of John McLemore that handled the Birman bankruptcy.VERY unhelpful. He simply stated that they handled the bankruptcy and any assets sold after that were out of their hands. After giving me a lecture about how the SEC won't help because they are controlled by Republicans, he told me I should be talking to a lawyer closer to home rather than bothering him.
Then I called Delaware and the lady I spoke to(did not catch her name) informed me that nothing was ever filed with the state regarding the Birman bankruptcy and it was the attorneys job to do this.
