You are attempting use some form of clintonian "depends on what your definition of is is" to claim that a formal agreement has no legal weight or consequences. Look up "contract". A contract is an agreement or promise - this one just happens to be "executed", handshake or signature, any judge is going to look for that.

Meanwhile, the "formal agreement" calls for approximately 3 million gallons annually. Because I'm sure you are being honest with your statements, could you please advise us as to how you know it will only be "10 gallons per week for five years"?
