I did not say Neom had to respond to preserve its rights of appeal.

I simply indicated that if Neom does not want the patent examiner to exclusively use the EFF submission to inform the re-examination, the Neom should respond. And I am certain Neom will.

BTW, this is an ex parte reexamination, meaning that the EFF has no right to participate further.

12/16/06 will be the fianl date by which NeoMedia either responds to the EFF's re-exam request or goes forward without wavering, all on the merits and stregnth of their core patent and its subsequent claims 1-95. From 12/16/07 forward, Anjan K. Deb will have 120 days, or until 04/16/06, to formulate a definitive decision.
