#60844 RE: hollywoodhills #60834

HH: I respectfully disagree. I have found that the best DD is to call the companies that e.Digital is making claims about to verify them.

The statement that the HD1213 was not in production as of 12/5 was made to me by a Senior Engineer at Eclipse. I posted it before Falk's claim to the contrary. After his statement, I was called a "liar."

Now it turns out that the company refuses to discuss who was telling the truth, Rich Coe or Fred Falk. Personally I believe Coe and I do not believe that Eclipse has told e.Digital not to inform their shareholders whether or not production has begun.

Remember that none of the SEC filings has ever mentioned an order from Eclipse or that there was an agreement for e.Digital to be paid for manufacturing.

Since I called Coe back after the ASM webcast to verify Falk's announcement (he stood by his earlier information), and it's possible that other shareholders called as well, it's possible that Eclipse told e.Digital not to make a false claim.

IMO, Falk got caught in a blatant lie and is now blaming yet another NDA for not being able to clear up the discrepancy.

I think that all of the shareholders who want the truth should write to the SEC to see if they can convince e.Digital management to come clean about the basis for their statements of supposed facts as well as forward-looking statements. Inquires from the SEC would certainly get their attention.

Stating that the HD1213 is in full production is not a forward looking statement. So perhaps their excuse is that it depends on what the meaning of the word "is" is.
