Yes, but the settlement process itself can be long, arduous and contentious. That's why usually a mediator is called in.

I've been through this more times than I want to remember, so I urge this caution. Sometimes the "settlement process" itself is used by one of the parties as a stall. Normally a judge will not proceed with a trial or much of anything while the parties are "in settlement discussions". I have confidence in Turrini and Cohn that they are watchful for this potential maneuver however.
