First, as intellectual property attorney, the proper suit would be based on trademarks and unfair competition, not copyright. Second, key questions are: who had or used the mark first in a particular geography, and was the mark used to sell confusingly similar goods. May not be a case if people in Vancouver aren't aware of use of the mark in the Northeastern US since there would be no likelihood of confusion between the marks.
