Sounds reasonable. I know I keep banging on about SCO, but this is a smaller but EXACT parallel case. They lost their claim to the UNIX copyright and are now dead in the water. They pissed off the judge in the same manner.

I wouldn't be surprised to see default judgment this week.

To add to this. I'm sure S-Rex is right on this. If it's obvious to the judge that Nexus/Briner is misusing court proceedings, then he's not going to waste his and the courts time. He'll just pass a default. The motion to quash was absolutely ridiculous! I thought that Kulwin's reply was professional and researched. Standing the two side by side was a no-contest, IMO.

They won't be put in default now until at least the end of next week. The judge has given them till then to reply. I'm sure they'll take it to the wire. I think we're looking till at least the following week for a default judgment.
