I think this allowance just has to do with the old news of having an agreement with Microsoft first and then getting a trademark. Most likely they did it that way as to stave off a law suite from Microsoft. In that if you got the trademark first Microsoft could have protested that the name was to similar to their X BOX trademark. But since they have the agreement with Microsoft they can proceed with their trademark name. JMO.
