I think the shell could get sued certainly, but I don't think if someone took it over they could individually get sued. Fraud requires a false representation and an intent, and you can't be liable for that if you didn't make it. Poor rca might get sued, but he's said he's willing to take that risk and would cooperate with any plaintiffs with truthful answers even if it meant that he could be found to have breached fiduciary duty.

I am new here, I want to know Replevins interest here, he talks alot of BS and then what. I will buy up the float and join the BK and let the judge decide. To me it will be easy as no one IMO will step up and lay claim to this shell and it will come out of BK clean giving the shareholders a chance to recover something. JMO
