UpNDown, I suspect that since IBM is cash rich (and AMD is not), AMD may have agreed to let IBM own many jointly developed patents in trade for long term (maybe perpetual) licenses for AMD to use them. Thus AMD gets to use the process as long as they want, and IBM gets to sell parts of it to third parties.
