He mentions looking for a big drop in sp if an injunction "comes in". Actually I think the reverse could be true.
Finality (or knowledge in the govt's case) in just about any form of action against Offor would release the 'unknown factor' acting as a cap on the stock presently. Savvy buyers with bags of cash are waiting on the sidelines.
