Can anyone remember e.Digital ever releasing a 10Q or 10K without an accompanying PR?
FWIW, the language in the 10K regarding the lawsuit is not as strong as the language used in the legal pleadngs. For example, e.Digital says the following in the introduction to Docket 96 (96 ED Memo in Opposition to DC Motion for Summ Judgmt.pdf see here: http://www.box.net/shared/on2000kiv4 ) regarding digEcor's motion for an injuction:
"...the injunction it seeks would cripple—if not entirely terminate e.Digital’s business."
Yet in the 10-K, edig simply says:
"In April 2007 digEcor filed a motion for summary judgment seeking enforcement of an alleged noncompete provision and an injunction prohibiting e.Digital from competing with digEcor, to which we responded in June 2007. We believe we have substantive and multiple defenses and intend to vigorously challenge the pending summary judgment motion and all remaining matters. Due to the uncertainties inherent in any litigation, however, there can be no assurance whether we will or will not prevail in our defense against digEcor’s remaining claims. We are also unable to determine at this time the impact this complaint and matter may have on our financial position or results of operations."
