IMO,he needed some more concrete proof of the share problem out there,by going this route he now has or will have a signed paper from a judge showing the share count is or was approaching the legal count that was tradable.

Again, he has to know where Pino went with the shares to get a judgement against him. How else could he have won against Pino?

Easy, Pino et al quickly settled w/ BCIT. The case never went into the discovery phase or to trial. Plaintiff also granted dismissal for two defendants over lack of jurisdiction.

This was never about counterfeit shares as far as TM was concerned...TM says lets trade!....DTC says sorry but to many bogus shares on the market...TM says, no, they are naked short shares generated by the your system!...DTC, Ha!, no such thing as NSS, don't you read our press releases?...TM says over 1 billon shares traded legally through your client brokers on a 4K float!...DTC - PROVE IT!...TM says, OK you asked for it! ;)
