I’m not going to get into it with them if it can be helped,
They probably have a legal staff larger than the population of my entire town,
and their probably always looking for someone to do.
The issue of court jurisdiction had been brought up yesterday.
I use E’trade ( and E’trade uses me), and I don’t see any office or store front ( there are 13 of them) for them within the state of Oklahoma , and I don’t live there. The electronic account credits that pass for “stock” in this virtual reality were not transacted directly with BCIT, ( they do have an office in that state ?) so it seems tenuous for a Oklahoma court to impose jurisdiction.
E’trade’s customer agreement says it is to be deemed to be made in and under the laws of the state of New York.
I am thinking of adding a statement to my response reserving the right to challenge the jurisdiction of a Oklahoma County Court at some point in the future. Of course if this were a federal court there would be no issue here.
Well reasoned responses would be welcome.
