Wouldn't waste your time. This is a non-reporting pink...you can petition the SEC for delisting, however don't expect it to happen overnight. As far as a cash settlement. Buy a mega-millions ticket...your odds are better there. No lawyer would waste their time here.

their only chance to avoid such a lawsuit is now:

1) issue 3-year financials as promised
2) buyback enough shares, so that the share price is equal to the one when they voluntarily anounced the date for the financials
