Intel will have a lot of trouble licensing AMD64 because the pill is too bitter for Chipzilla to swallow.

I think it has more to do with pride, and with the overriding desire of Intel to corner the market (one way or another), than with technicalities of licensing AMD64 from AMD. It may already be covered by the cross-licensing agreement between Intel and AMD.
