I think the sealed agreement grew out of VPLM realizing where the opposing lawyers were taking them. Once it became clear that another 2 or 3 or 6 years of litigation was on the horizon, VPLM probably said they would back out if the opposition agreed not to pursue counter actions.
In other news, they have truncated the definition of insanity (from doing the same thing over and over and expecting a different result) to Voiping.
