Hunterbrook asked for info from the SEC and they said they couldnt provide what was requested and cited a rule that prevented them from disclosing anything from an on-going investigation...Hunterbrook followed up with a second request and was told the the SEC "confirmed with Division of Enforcement staff that the investigation from which you seek records is still active and ongoing."...
SMR replied that they have not been informed of an SEC investigation into them...
well, they wouldnt be until the investigation is almost completed or reaches a point where they have to start interviewing SMR employees or management...
the fact that SMR didnt state that they were unaware of any such investigation is telling....they likely ARE aware...but what they said is that the SEC hasnt TOLD them they are investigating...
it seems pretty clear to me that there IS an investigation...it could be big or it could be nothing...but SMR's response to the issue tells me it is SOMETHING....and they know EXACTLY what it's about...
