Actually, they can. And it is no assumption. Per the FDA's published guidance...check out my earlier post of the web page. It spells it out out there very clearly

wrong, wrong, wrong. 30 days, no word from FDA = approved

Sunday, July 28 is day 30… Monday July 29 would be the first day of trading as approved in that scenario
