Christ on a crutch!! No one--not E Jean, and not her attorneys--ever claimed vaginal penetration took place. It was clear from the outset that he stuck his finger up her vagina. No problem with her tights; it'd be easy to pull them down a little. The State of New York doesn't define that as rape, but I think most women would.
