So, it wasn't an actual dividend payment but assessments sent to UST, in the form of capital distributions, under the guise of dividend payments (Restricted and unavailable Earnings for distribution, out of an Accumulated Deficit Retained Earnings accounts)

The dividend was impeccably suspended for the recapitalization of FnF.

It is my guess that all federal judges have been given implicit instructions to tow the government line. Mr. Angel's request to amend was rejected by Sweeney (who was thought to be in our court early on, but has proven to be nothing more than a rubber stamper for the government narrative) and, my guess is, Bryndon's request will also be summarily dismissed - not based on the merits, but on the implicit instructions these judges have end these cases, or in the case of Lamberth to delay or find ways to negate or subdue positive shareholder precedence. There is NO defeating what the government wants.

Remember, the last amendment to the agreement between FHA and UST states there is NO C'ship exit UNTIL all court cases are settled. Now, that being said, there could be a slim possibility the government just wants to kill any future opportunities to sue the government for vast sums while intending to set the record right by shareholders to some extent. None of us has any idea. If you wait long enough there will be nobody of any means left to sue the government if, in the end, it decides to take EVERYTHING. They'll have no problem using taxpayer money to make Ackman or someone else of means waste their own money to fight it. But I do think that may be something (taking everything) they will try to avoid or at least obfuscate to the largest extent possible.
