Most likely it is this. Sometimes it could mean the two parties have reached an agreement but more than likely they are waiting on the appellate decision.

Agree! The case is on hold until the appeal Purdue made after losing the patent case to Intas goes through the courts. Looks like that appeal is coming up in mid Feb.

This line says they lost a patent case to the Indian company:

WHEREAS, the asserted claims of three asserted patents from the '872 Application Family (U.S. Patent Nos. 9,763,933; 9,775,808; and 9,763,886) were held invalid for obviousness after a bench trial in a case captioned Purdue Pharma L.P., et al. v. Accord Healthcare Inc., Civil Action No. 20- l 362(RGA) in the District of Delaware ("the Accord I case");



This line says Purdue appealed:

WHEREAS, Plaintiffs have appealed the decision in Accord I to the U.S. Court of Appeals for the Federal Circuit in Case No. 23-1953 and the issues have been fully briefed ("the Accord I appeal");



This line says appealed case is in mid - Feb

WHEREAS, allegations of invalidity of the asserted claims of two additional patents from the '872 Application Family (U.S. Patent Nos. 11,304,908 and 11,304,909) are to be tl'ied before the U.S. District Court for the District of Delaware on February 12, 2024 in a case captioned



Then in section labeled 2 it goes on to say that this case will be on hold for 6 months maybe longer.
