Consider this alternate possibility: Close of Fact Discovery was on August 25, 2023. HDC attorneys identified substantial infringement damages. Intel sees this and comes forward with an out of court settlement offer that HDC finds irresistible. The settlement agreement is inked 6 days later on August 31, 2023, thus there was no need to submit a damage report to Judge Albright on September 8, 2023, because this case was settled out of court on August, 31, 2023. And, I maintain that the settlement offer had to be substantial enough for HDC to dismiss its winnable case "with prejudice."
