I personally learned how closely money spent by POTUS must be to the original Congressional authority as written --- that I agree and disagree.

If nothing in the DOT budget authorized this money - it can not be spent. And if it is - then it will go to court and Executive will lose

This was and is true for the WALL (no F and F money and no other non appropriated money)

Again - I learned this with a tiny sliver of the ACA. The ACA includes wording that tells hospitals - for those with a private ACA policy but still seriously low income or unemployment or such - they CAN waive deductibles and co pays and the insurance companies that issued the private policy are to pay them back. Hospitals did this. Insurance companies paid Hospitals. Some 20 or so R states sued for use of money that was not line item appropriated. Scotus said - despite the wording of the ACA and every one's expectations - since this expenditure was not line item appropriated - the FED GOV could not pay insurance companies for paying hospitals and IT ALL STOPPED. (And again - for context - anyone who thinks the ACA was funded in any indirect fashion ---- just search for ACA taxes and it will blow your mind ((to include a surcharge on some stock trades))
