It is an expense now (write off) because the jury has ruled. Earlier it was just a statement in their disclosures about potential payouts.

If it is a reserve (i.e. an estimation), it should be whole number. $491 is more of an exact number. The report should be compiled a few days ago. So, they worked out the "5% over Federal Reserve" already. IMO.

I think it's in the 4th Letter Agreement.

The sentence I underlined in red could mean that $5 billion has been set aside as a maximum provision for the settlement of the remaining litigation:

It was said (I think) during Mnuchin Calabria, 5 billion set aside for legal payments. That right there is a full on admittance there is wrong being dealt against shareholders. IMHO
