Of course Nasdaq could give a grace period during a lawsuit. If MULN were to win their case and show evidence that their SP was negatively effected by illegal trading activity preventing them from meeting compliance, Nasdaq would be opening themselves up to a new lawsuit by delisting MULN during their current lawsuit.
Regarding the R/S, yes they may request an R/S if MULN can’t reach compliance organically, however, I don’t believe compliance will be an issue with news or with a grace period being granted.
