property, governments have conscripted property
owners into serving the state without compensation

a city population votes a city council and Mayor who put in place rent control of some kind

why is it correct for a court to refute ?

who gets to decide what is GOV over reach - the people or the courts ?

May or may not be a good example - but be careful of robbing citizen votes in the name of judicial power
