It is Fannie and Freddie that have to pay up. Fannie is chartered in DE and Freddie is chartered in VA. Treasury may effectively own them but fhfa does not have any ownership stake they gave it away to treasury acting on behalf of the gse's. Either way the suit is not against treasury at all. Lamberth can't choose which state laws he wants.
