Hi Robert, Dont you think the Sweeney Opinion was expected. I would imagine Brydon would submit a Petition for Cert? If Cert is denied then that will be it. Next up will be the Orals in Collins and the CFPB case at SCOTUS to see if they say anything about the FHFA. They switched judges on us in Kelly which is probably a negative but a long shot in any case. Seems like 2024 will be the toward the end of the road for litigation?

I thought we finished all but the request for EN BANC

Sweeny a while ago - ruled against us citing the decision of the Circuit Appeals Court (which is also the appeals court for Claims court)

The Plaintiffs appealed and just now a three judge panel said nope ---- nope --- nope

So are we knocking on the door of the EN BANC request - having exhausted all of the rest ? (and facing a three judge decision against us at the appeals level??)
