I don't know. It has to exist somewhere because every contract comes with an implied covenant of good faith and fair dealing, and that is what the jury ruled was breached by the NWS.

There must be some key difference between the contracts of FNMA and FMCC shareholders for the lawyer to have said that.

It's possible I misunderstood the source, but if it's true then FNMA holders won't be able to get any damages at all from a similar implied covenant lawsuit. Something to keep in mind when you decide what shares to own.
