That would be a good reason not to announce the BE. From a CC done about 6 months after the Adderall ER launch I remember Nasrat explaining poor Adderall ER sales. In explaining our inability to penetrate the Adderall ER market anymore than we did under Lannett, he explained if drug companies know a new generic is coming out they go out and renew their contracts...locking up those customers until the contract expires. Making Elite wait 6 months to a year to market to those companies because they couldn't change until the contract was up.
Of course now we know alot of it was also Lannett not really trying..

The good news is that in the last CC Nasrat did say

We always issue press releases when we submit an ANDA with the FDA.

and

Just to make sure that everybody understands me, two of the three needle mover ANDAs as I spoke of will be filed this year.
