SFRX and associates really know how to play the victim. Not one long called him out and explained how he misinterpreted the law.

It's perfectly within DHR's authority to issue exploration permits. Locating things does not disturb objects entitled to sovereign immunity. By my reading of Florida Ch. 267, DHR has the authority to issue permits for the recovery of state-owned objects on state lands, including submerged lands. DHR does not have the authority to issue permits for the recovery of objects that aren't owned by the state.

Now, if a shipwreck is subject to sovereign immunity and/or is owned by a foreign nation (see the SMCA), based on that reading of the law, sure: it may not be possible for Florida to issue a permit for the recovery of that shipwreck or associated objects (because it doesn't belong to the state to begin with, which also means that the state can't transfer title of that thing since it doesn't hold title to that thing).

Neither DHR/BAR or Seafarer created those issues or wrote the laws (all of those folks are long gone), but they are the sandbox in which everyone has to play. I actually wish them the best of luck, believe it or not. I told both Kyle and Tim a long time ago that if they could find a way to truly partner with Spain/Spanish researchers then the door would probably be wide open for them. But the tendency is for people to focus on "the state."



9 seasons and 6B shares down the drain at Melbourne, and we find out it was never an achievable goal even if they’ve were actually on “the wreck” as Kyle falsely claimed they were in 2016 unless they got permission from Spain.

But hey, at least the stock trades, right?
