The thing is it was incorrectly stated that the investigation was informal when trading was suspended.

When an SEC investigation moves from "informal" to "formal", the company under investigation gets a letter explaining that fact. So it's entirely possible that the letter hadn't yet been received when CKYX put out its initial PR.
