The suit according to what I read is not against DNAP, but, a now-defunct company. You might want to re-read the news item re: DNAP you posted.

You left out the context of the quote. (Not playing tricks are you?)

The plaintiff, a Montana resident named Lonnie Bookbinder, alleges breach of contract, fraud, and conspiracy, among other claims, against the company, its CEO Richard Gabriel, its Chairman and Chief Medical Officer Hector Gomez, and a now-defunct company called Genbiomics.

You shouldn't leave out mention of Genbiomics. After all it is the last company that Gabriel and Gomez ran into the ground before they landed at DNAG.
