Intas (Accord) spent the money to challenge the patent. They get 180 days exclusivity. The FDA does this to encourage generic companies to challenge questionable patents. If all the companies could jump in as soon as a patent was invalidated there would be insufficient incentive to pay the legal fees. Don’t take my word for it. Look it up.
