The court is not "giving weight" to that argument. It is specifically saying that the "appellant contends" - not that it is putting weight on it.

Stop trying to skew the information that is actually there.

The decision states "this court concludes that further briefing on these jurisdictional issues is warranted."

That is definitely giving weight to the arguments. Otherwise, the court would have dismissed the case without asking for further briefing, because they would give no weight to the arguments. They're giving weight to the arguments, while also giving Sharp a chance to counter the arguments.
