Just saw the update... Im surprised that they took this route actually... I thought that the court would either find that Calasse had no standing and dismiss the case -or- (and highly unlikely in my mind) decide that Calasse did have standing, reinstate briefing and move forward focusing on the actual appeal itself.
Evidently this scenario is such an odd bird (the "standing" issue and the mechanics of it) that the court is actually attempting to set a legal precedent here. It would appear that it (the court) has not crossed a bridge such as this one before, thus the request below.
