They file lawsuits in West and East Texas cause the Judges follow the constitution. They do claim construction first so they can understand the patents better. It’s really not “favorable” I would call it fair.
Now Judge Albright believes that if you own IP then you are entitled by the constitution to protect your IP, and if you’re gonna lose it will be with a jury trial if requested. I read in one of his cases that he dismissed after claim construction because the patents were very weak. He is fast so if you go to his court you better be ready. Judge Albright does not allow the defendants to use stall tactics and other time consuming motions. I read were he moved the dates up in a case after a defendant filed a mandamus.
I’m just glad that we have him as our Judge cause in Cali the system is rigged and a scam as those judges don’t seem to care about constitutional rights.
