Sharps team simply addressed (thoroughly) what Classe's team presented in their response to the court's order to show cause.

Sharps team was wise to address every aspect of Calsse's response ...even though much of Calasse's response was irrelevant to the court's order.

I had questions regarding Sharps lengthy response and I asked the legal council that I deal with about this specifically. I was informed that every aspect of Calasse's response needed to be addressed in an extremely thorough manner, beyond the cherry-picked aspects that Calasses team initially provided the court.

I agree with the statement above... But pertinent to the courts order or not, Sharps team had no other choice but to deal with ALL aspects of Calasse's initial response (whether it was what the court asked for or not)



If your description of the filing was accurate, I would agree. It is smart to deal with all aspects of the response and be extremely thorough.

But your description is completely incorrect when reading the actual filing. The reply spent 11 pages dealing with statements of fact that had little to no relevance to the response or the OSC. It regurgitated "facts" that had been previously covered in all filings in the district court.

In contrast, the reply only spent 3 pages on the "Argument and Authority" section, which should have been the focus. This included conclusory statements without much reference to Authority. I haven't done a comparison between the two, but my guess is it didn't address several arguments in the previous response.

And more importantly, I wasn't really referring to the 15 pages of argument. That wouldn't hold up the court in making a decision. What I found laughable was including an Appendix that spanned three separate documents, most of which was already filed with the district court and thus unnecessary. Take a gander at Exhibits A-O and tell me which ones are relevant to the OSC.

Agree. Sharp reflected that sentiment. Calasse's defense is weak. When it's finally addressed, this will get tossed. LFG
