#62807 RE: FEARANDGREED #62805

Perhaps tomorrow, perhaps end of March, perhaps April. I agree that the court will take as long as if wants to before filing the decision.

But I think it is disingenuous to claim you don't think a lengthy decision bodes poorly for the appeal being dismissed. The order to show cause made it very clear, if Calasse wasn't a party then he lacks standing to appeal and the NVSC is without jurisdiction and the appeal will be dismissed.

If they review the filings and decide he lacks standing, it will be a 2-3 page response. Maybe a few extra paragraphs to say "we considered your other arguments and found them to be without merit." You can click on Valley Bank and see cases that cited Valley Bank while dismissing the appeal in a very short decision (they're mixed in, but especially towards the back of the 187 citing cases). Most of them were dismissed in 2-3 pages, and many of the unpublished opinions were only 4 paragraphs long!

On the other hand, if the court drafts a long decision (6+ pages), that means there are complicated issues to work through. Since jurisdiction is pretty straightforward, the only reason the decision will be long is if the court addresses other issues raised by Calasse, which doesn't favor Sharp.
