I have mixed thoughts on all of this emerging "standard"

I am sure there will be times when I love it and the outcome and times when I do not

And if I were say 30 or 40 (v 70) - I would bet today - today - that in say 30 years this doctrine or approach will be replaced with something a different court comes up with
